1.0 Website Use

All photographs on www.daramsphotography.co.uk website are the property of Joe Darams Photography UK.

For the avoidance of doubt, all copyright of the photographs is owned absolutely by Joe Darams Photography UK within the provision of the UK UK Copyright Law with the exception of Stock Photos which we have full permission to use.

Photographs on the website and the blog are for demonstration of the photographer’s work only.

We respectfully remind you that it is contrary to this Terms and Condition to copy or allow to be copied photographically, electronically or by any other means any photograph without the express permission of Joe Darams Photography UK. Likewise, the photographs may not be in any way modified, and no derivative work may be made from the images without the permission of Joe Darams Photography UK.

All the information is correct at the time of being published on the website. Joe Darams Photography UK retains the right to change any information on the website without notice.

2.0 Supply of Services

Joe Darams Photography UK shall supply services to its clients in accordance with what is agreed in writing at the time of booking, in all material respects and as per our terms and conditions on Joe Darams Photography UK website.

Joe Darams Photography UK shall use all reasonable endeavours to meet any performance dates specified in the agreement or as subsequently agreed by Joe Darams Photography UK in writing, but any such dates shall be estimates only and time shall not be of the essence for performance of the Services.

Joe Darams Photography UK will not be liable in any circumstances for the consequences of any delay in delivery or performance or failure to deliver or perform if the duration of the delay is not substantial or if the delay or failure is due to late delivery or performance or non-delivery or non-performance by suppliers or subcontractors, shortage of labour, equipment failure/breakdown, an act of God, fire, inclement or exceptional weather conditions, industrial action, hostilities, governmental order or intervention (whether or not having the force of law) or any other cause whatever beyond our control or of an unexpected or exceptional nature.

Joe Darams Photography UK shall have the right to make any changes to the services which are necessary to comply with any applicable law or safety requirement, or which do not materially affect the nature or quality of the services, and Joe Darams Photography UK shall notify clients in any such event.

Joe Darams Photography UK warrants to clients that our services will be provided using reasonable care and skill.

3.0 Photos Session Booking

When booking a photo session, you agree to the following terms and conditions:

Date and time are to be agreed with Joe Darams Photography UK.

Digital files from a photoshoot remain the property of the Photographer. For the avoidance of doubt, all copyright in the images are owned absolutely by the Photographer within the provision of the UK Copyright Law.

A non-refundable booking fee of specified value shall be paid in order to secure the date and time for a shoot. The remainder (total services and products price less booking fee) shall be paid any time before or on the day of the photoshoot.

Additional photographic services or products shall be paid for in full at time of ordering.

4.0 Delivery Policy

Prints, USBs or DVDs may be sent using standard courier services upon payment of agreed delivery cost. Other products, such as frames or photo books may be required to be collected from the photographer due to the fragile nature of the products or value of their content. In this case, collection must be made by appointment.

5.0 Cancellation Policy (Photography Services)

In the event that you do need to postpone your already booked photoshoot or studio session, we require 14 days’ notice or a cancellation charge, equivalent to your booking fee, will apply.

Joe Darams Photography UK will always try to accommodate changing schedules and will be happy to refund or postpone any session if cancelled or rescheduled within the notice period.

Because of the bespoke and customised nature of our photographic products (prints, photo books, albums, frames etc.), after the photographic product order has been placed, it cannot be cancelled.

6.0 Return and Refunds Policy

Once the photographic products have been checked, collected and signed for, no returns will be accepted, nor will any refunds be made by Joe Darams Photography UK.

In case of delivery of photographic products to the client by post, any complaints regarding an issue with photographic products such as manufacturer’s fault/defect shall be sent to Joe Darams Photography UK in writing within 14 days of receipt of the products, along with the faulty photographic products. Joe Darams Photography UK will rectify the problem and endeavour to supply the photographic product to the client as soon as possible. After the 14-day period, no returns on photographic products will be accepted and no refunds will be made by Joe Darams Photography UK.

7.0 Force Majeure

For the purposes of this Terms and Conditions, Force Majeure Event means an event beyond the reasonable control of Joe Darams Photography UK including but not limited to strikes, lock-outs or other industrial disputes (whether involving the workforce of Joe Darams Photography UK or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

Joe Darams Photography UK shall not be liable to the client as a result of any delay or failure to perform its obligations under their contract as a result of a Force Majeure Event.

If the Force Majeure Event prevents Joe Darams Photography UK from providing any of the Services for more than two weeks, Joe Darams Photography UK shall, without limiting its other rights or remedies, have the right to terminate the contract immediately by giving written notice to the Client.

8.0 Complaints

Please address any complaints to Joe Darams Photography UK by email or in writing to the address below. We endeavour to respond to any complaint within one working day.
