The Business has carried on, and continues to carry on, its operations under the names “Joe Darams Photography,” “Darams Photography,” and “Darams Media Production.” Below are our detailed Terms and Conditions, which aim to ensure clarity, fairness, and professionalism in our services.

1.0 Website Use

1.1 All photographs on www.daramsphotography.co.uk are the exclusive property of Joe Darams Photography UK and are protected under UK Copyright Law.
1.2 Stock images used on the website are fully licensed, and permission has been obtained for their use.
1.3 The website and blog content are for showcasing our work and are not to be copied, modified, distributed, or used in any form without explicit written permission.
1.4 Any unauthorized use of images or content from our website will result in legal action.

2.0 Supply of Services

2.1 Joe Darams Photography UK provides agreed-upon services as outlined in your booking confirmation.
2.2 We will make every effort to deliver services on the agreed dates, but delays may occur due to unforeseen circumstances beyond our control (e.g. equipment failure, adverse weather, or acts of God).
2.3 Should delays occur, we will notify you promptly and take steps to minimize disruption.
2.4 Joe Darams Photography UK reserves the right to adjust services as required to comply with legal or safety requirements.

3.0 Photo Session Booking

3.1 A 30% non-refundable deposit is required to secure your booking.
3.2 The remaining 70% balance must be paid on or before four weeks prior to the session.
3.3 For bookings made within four weeks of the session, full payment is required upfront to confirm the booking.
3.4 Payment secures your selected date and time, which will be agreed upon with Joe Darams Photography UK.
3.5 All digital images remain the property of Joe Darams Photography UK and are protected by UK Copyright Law.
3.6 Additional products or services ordered after the session must be paid for in full at the time of ordering.
3.7 Any requests to change the date or time of a confirmed session must be made at least 14 days in advance. We will do our best to accommodate such requests but cannot guarantee availability.

4.0 Payment Policy

4.1 Payment can be made via bank transfer or other methods as agreed upon in writing.
4.2 Receipts will be issued for all payments upon request.
4.3 Failure to make the final payment as per the terms may result in the cancellation of your session.

5.0 Delivery of Products

5.1 Digital files will be provided via a secure online gallery unless stated otherwise. Access to online galleries will be available for four weeks, after which the gallery may be archived or removed.
5.2 Physical products (e.g. prints, frames, photo books) may be sent via courier or collected in person by appointment. Fragile or high-value items must be collected to ensure their safe delivery.
5.3 Joe Darams Photography UK is not responsible for damages during transit when a third-party courier is used.

6.0 Image Rights and Model Release

6.1 Joe Darams Photography UK retains full copyright of all images as per UK Copyright Law. Clients are granted a personal license for non-commercial use of delivered images.
6.2 The Client grants Joe Darams Photography UK the right to use photos and videos from the session or event for lawful promotional purposes, including blogs, social media, websites, advertising, and portfolio displays.
6.3 If the Client does not consent to the use of their images for promotional purposes, they must notify Joe Darams Photography UK before making payment. A non-disclosure fee of £50 per shoot or event will apply.
6.4 Clients must communicate any restrictions regarding image use in writing before payment.

7.0 Creative Licence & Artistic Style

7.1 Joe Darams Photography UK has creative discretion over locations, poses, and the style of photography or videography.
7.2 Specific shots are not guaranteed due to factors like weather, subject availability, or location restrictions.
7.3 Clients acknowledge familiarity with Joe Darams Photography’s evolving artistic style and trust its professional judgment to create unique, high-quality results.

8.0 Cancellation Policy

8.1 Clients may reschedule a session with at least 14 days’ notice. Failure to provide sufficient notice will result in the loss of the booking deposit.
8.2 Cancellations or changes within the notice period may be subject to additional charges, depending on circumstances.
8.3 In the event of unforeseen circumstances (e.g. illness, extreme weather), Joe Darams Photography UK reserves the right to reschedule the session or provide a substitute photographer.

9.0 Complaints and Disputes

9.1 If you have any concerns or complaints, please contact Joe Darams Photography UK in writing via email or post.
9.2 We aim to respond to all complaints within one working day and will work to resolve issues promptly.
9.3 Disputes that cannot be resolved amicably will be referred to mediation or arbitration before considering legal action.

10.0 Force Majeure

10.1 Joe Darams Photography UK is not liable for failure to deliver services due to events beyond our control, including but not limited to natural disasters, government restrictions, strikes, or equipment failure.
10.2 If a Force Majeure event prevents the completion of services for more than two weeks, either party may terminate the contract with written notice.

11.0 Refunds and Returns

11.1 Due to the bespoke nature of our products, refunds cannot be provided once orders have been placed and processed.
11.2 If a product is found to have a manufacturing defect, you must notify us in writing within 14 days of receipt. We will replace or rectify the issue promptly.
11.3 No refunds or returns will be accepted after the 14-day period.

12.0 Additional Terms for Event Coverage

12.1 For event photography or videography, clients must provide a detailed schedule and discuss access requirements with the photographer in advance.
12.2 It is the client’s responsibility to secure necessary permissions for photography at the event venue.

13.0 Governing Law & Jurisdiction

13.1 This agreement and any disputes or claims arising out of or in connection with it shall be governed and construed in accordance with English Law.
13.2 Both parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising under or in connection with this contract.

14.0 Privacy and Processing of Personal Data

14.1 Joe Darams Media Production complies with the EU’s GDPR (General Data Protection Regulation) and the UK’s DPA (Data Protection Act) regarding the collection, use, and storage of personal data.
